Terms of service
These Terms and Conditions describe the basis for the purchase by you and sale by Addicted to Handbags of the goods described on www.addictedtohandbags.org (the “Website”).
These terms and conditions should be read alongside, and are in addition to, Addicted to Handbag’s Privacy Policy which tell you how we use your personal information.
Terms and Conditions
1. Definitions
All references in these Terms and Conditions to the singular shall include the plural where applicable, and all references to gender shall include both genders and the neuter.
“% Commission Charge” means the percentage of the Resale Price which Addicted to Handbags charges for a Consignment Sale.
"Acceptance of Item" means the point at which the Buyer provides Written Acceptance they intend to keep the item or 14 days from Receipt of Item, whichever comes first.
“As-is” means the present, existing condition of the Item.
"Buyer" means the person who buys or agrees to buy the Item from the Seller.
“Checkout” means the secure Shopify checkout which accepts orders and take payments.
"Conditions" means the conditions of sale set out in this document and any special conditions agreed in writing by the Seller.
"Consignment Sale" means where an Item is sold by Addicted to Handbags on behalf of a private seller.
"Contract" has the meaning as described in Section 2.
“Day” means a calendar day.
“Delivery Carrier” means the company or organisation responsible for the shipment of an Item.
"Delivery Charge” means the cost to ship an Item.
“Designers, Brands or Manufacturers” means those companies who have designed, produced or manufactured the Item.
“Direct Buy Price” means the price agreed between Addicted to Handbags and the Sender for a Direct Buy Service Item.
“Direct Buy Service” means where Addicted to Handbags agrees to purchase an Item from a Sender at an agreed Direct Buy Price.
“Import Duty and Customs Fee” means any payment levied on the import of an Item.
“Initial Part Exchange Price” means the price for which a Part Exchange Service Item is originally advertised for sale by Addicted to Handbags.
“Initial Resale Price” means the price for which a Consignment Sale Item is originally advertised for sale by Addicted to Handbags.
"Item" means the physical goods subject to sale via Addicted to Handbags.
“Part Exchange Price” means the price for which a Part Exchange Service Item is currently advertised for sale by Addicted to Handbags.
“Part Exchange Service” means where the Sender sends Addicted to Handbags an Item in exchange for an Item listed on the Website along with any further payment required as agreed with Addicted to Handbags.
“Purchase Confirmation” has the meaning as described in Section 2.4.
“Receipt of Item" means the point at which the Item is Signed-For on delivery (this does not have to be by the named individual on the invoice).
“Resale Price” means the price for which a Consignment Sale Item is currently advertised for sale by Addicted to Handbags.
“Return” means the Buyer sending the Item back to the Seller.
"Seller" means Addicted to Handbags.
"Sender'" means the individual sending an Item to Addicted to Handbags for resale purposes.
“Sole Marketing Agreement” means Addicted to Handbags has the exclusive right to the Consignment Sale.
“Sole Marketing Agreement Period” means the 20 week period commencing from the date on which Addicted to Handbags receives the Item for a Consignment Sale.
“Website” means www.addictedtohandbags.org.
“Working Day” means any day other than a Saturday, a Sunday, Christmas Day, Good Friday or a day which is a bank holiday in the United Kingdom.
“Written Acceptance” means confirmation by way of any form of electronic communication.
2. Conditions
2.1 These Terms and Conditions do not affect your statutory rights as a consumer.
2.2 The Terms and Conditions set out in this document shall prevail over any other communication from the Sender or Buyer if not agreed in writing by Addicted to Handbags prior to Contract.
2.3 Confirmation of acceptance of these Terms and Conditions by the Buyer at Checkout shall be deemed conclusive evidence of full acceptance.
2.4 The Seller will confirm acceptance of the Buyer’s order for goods by sending the Buyer an email confirming the goods have been ordered (“Purchase Confirmation”). The contract between Buyer and Seller will only be formed when the Seller has sent the Purchase Confirmation following checkout completion (the “Contract”). Note that all legal disputes related to card processing are handled under UK Law.
2.5 Any services offered by Addicted to Handbags is by invitation only. Addicted to Handbags retains the right to refuse any provision of services and cancel Contracts to both Senders and Buyers at its discretion.
3. Warranty and Liability
3.1 All items are sold As-is and therefore no warranty is given or implied. Items sold described as in a '’New' condition or 'As New' remain under the classification of pre-owned. Whilst such items may still be under manufacturer’s warranty, it is the Buyer’s responsibility to confirm any warranty period prior to contract. The warranty remains with the manufacturer, not Addicted to Handbags.
3.2 Addicted to Handbags accepts no liability at any time for defects or issues arising after Acceptance of Item by the Buyer. Under no circumstances shall Addicted to Handbags be liable for any indirect, incidental or consequential damage. Any personal injury related to the Item at any time is entirely at the Buyer’s own risk.
3.3. Where available, original or copies of receipts will be advertised and can be requested by the Buyer, up to 14 days after Receipt of Item. Any documentation advertised does not form part of the condition of sale at any time.
3.4 While every effort is made to ensure that the item descriptions are accurate, the nature of the goods means that the condition can be subject to personal interpretation.
3.5 Addicted to Handbags will endeavour to describe any strong or noticeable odours, however, due to the preloved nature of items, scents and odours are received differently by individuals. Addicted to Handbags cannot guarantee the absence of odours or scents.
3.6 Due to the preloved nature of items, Addicted to Handbags cannot guarantee the history of items and cannot confirm whether items are from pet free environments. Under no circumstances shall Addicted to Handbags be liable for any injury or illness as a result of allergies arising from exposure to any Item sold.
4. Prices
4.1 Prices on the Website are displayed in pounds Sterling (£ GBP) and include Delivery Charges.
4.2 The total purchase price, including any Delivery Charges will be displayed on the Website at Checkout.
4.3 Prices are non-negotiable.
4.4 Payment must be made in full before dispatch of any goods.
4.5 Where a deposit is taken up front for an item, the deposit is non-refundable. Similarly, where full payment is made for an item but dispatch is delayed per the request of the buyer, 10% of the payment is deemed to be a non refundable deposit in the event of any cancellation after a period of 10 days after purchase.
4.6 Our First Order discount is limited to one item per household to prevent fraudulent and repeated use of this discount code only intended for one order.
5. Delivery
5.1 All Items will be shipped via a fully insured, tracked and signed for shipping service within 4 Working Days of payment being cleared, unless the Seller advises otherwise (and this would be noted at checkout).
5.2 Addicted to Handbags shall not be liable for any expenses incurred by the Buyer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.
5.3. Items purchased will be shipped to the delivery address provided by the Buyer at Checkout. For international orders, the billing address must match the shipping address.
5.4. Tracking details will be provided to the Buyer within 24 hours of the Item being dispatched.
5.5. Addicted to Handbags will not accept any responsibility for any delays caused by custom clearance for international orders.
5.6. Any customs or import taxes payable will be solely the responsibility of the buyer and Addicted to Handbags will not be liable for these fees.
6. Non Receipt
6.1 In the event of the non-receipt of an Item, the Buyer should inform Addicted to Handbags of non-delivery within ten Days following Purchase Confirmation. After 10 Working Days following Purchase Confirmation, if the Item has still failed to arrive, and the tracking details do not indicate its arrival, Addicted to Handbags can file a claim with Royal Mail to claim compensation for the lost item. The Buyer will then receive a full refund (inclusive of Delivery Charges) on the earlier of Royal Mail concluding their investigation and providing compensation, or 30 days following the purchase date.
6.2. If Royal Mail have attempted to deliver an item, Royal Mail will hold an item for 18 days. If an Item is not collected or redelivery attempted within this time frame, the Item will be returned to Addicted to Handbags. For any Item returned to Addicted to Handbags, the Buyer will receive the option of a refund net of Delivery Charges plus a further surcharge of £100. If re-delivery is required, the Buyer will be responsible for the costs of redelivery before the item is dispatched again.
7. Customs
7.1 All Items shipped outside of the UK will have the final purchase amount declared as contents value, as per their enclosed invoice documentation.
7.2 Any Import Duty and Custom Fees due is payable by the Buyer directly to the levying country’s custom authorities. Amounts due are not the responsibility of Addicted to Handbags.
7.3 For any Item returned to Addicted to Handbags due to the non payment of Import Duty and Custom Fees, the Buyer will receive a refund net of Delivery Charges plus a further surcharge of £100. If re-delivery is required, the Buyer will be responsible for the costs of redelivery before the item is dispatched again.
8. Ownership & Risk
8.1 For Consignment Sale items, ownership of Items remains with the Sender until receipt of item has been confirmed by the Buyer.
8.2 Addicted to Handbags provides insurance cover for loss or damage of an Item whilst in Addicted to Handbags physical possession. Items are insured to their Resale Price less the appropriate commission to be deducted, less a further administration charge of £50 to cover the cost of any insurance claim.
8.3 Responsibility for any Item outside of Addicted to Handbags physical premises transfers to the Delivery Carrier until Acceptance of Item.
8.4 The Buyer shall inspect the Item within 24 hours of receipt of item. If the Item is assessed to not be in acceptable condition due to damage or defect the Buyer must contact Addicted to Handbags via email at returns@addictedtohandbags.org within 24 hours of receipt. If the Buyer fails to report any damage or defect during this period they are deemed to have accepted the goods in the condition received and ownership of the Item passes to the Buyer.
8.5 Any Item in respect of which any claim of defect or damage is made shall be preserved by the Buyer intact together with the original packaging and accompaniments. Photographic evidence of damage or defect must be provided prior to the Buyer sending the item back to the Seller.
8.6 If a Return is agreed by Addicted to Handbags, the Buyer must return the Item, (following all written instructions set out by Addicted to Handbags) for inspection within 24 hours of notification, at their own risk and expense.
8.7 Item and accompaniments must be received by Addicted to Handbags within three Working Days of Addicted to Handbags agreeing to a Return.
8.8 On receipt and inspection, if appropriate, a full refund inclusive of all Delivery Charges incurred will be issued to the Buyer via original payment method.
9. Cancellation
9.1 Cancellation instruction from the Buyer must be received by Addicted to Handbags in writing via email (returns@addictedtohandbags.org) and may take place up to the point at which the Item is dispatched (subject to s9.4).
9.2 Cancellation described in 9.1 does not result in a fee from Addicted to Handbags, however payments made via Debit/credit card, Paypal or Klarna are subject to a third party processing fee of 3-4% (deducted at source) which is not refundable. Refunds made following a cancellation will be reduced by the third party payment processing fee.
9.3 Once an item has been dispatched, a cancellation of sale follows the process of a Return per Section 10.
9.4 If shipment has been delayed following request by the buyer, please see section 4.5 for instances where cancellation occurs 10 days after order/payment.
10. Returns and Refund Policy
10.1 For all Items other than Consignment Sale Items and international orders, the following sections apply. Please note we do not accept returns on international orders.
10.2 If a return is required the Buyer is requested to notify Addicted to Handbags in writing within 2 Days of Receipt of Item and prior to the Item being sent back. The Buyer must notify Addicted to Handbags by emailing returns@addictedtohandbags.org and not via social media or any other form. Return instructions and address will be provided within 48 hours of notification and these must be adhered to in full in order for Addicted to Handbags to refund the Buyer.
10.3 Items must be returned in the same condition as dispatched, with all associated packaging and accompaniments in situ.
10.4 Please note Returns will not be accepted from a smoking environment, or if the item has acquired any aroma not previously present.
10.5 Items must be returned within 3 Working Days of receipt of return instructions from Addicted to Handbags.
10.6 The Buyer should return via a fully insured, trackable method. The tracking number should be provided to Addicted to Handbags within 24 hours of dispatch.
10.7 Items returned from overseas must be marked as 'Returned Merchandise'. Any Import Duty and Customs Fees incurred by Addicted to Handbags will be deducted from the amount to be refunded to the Buyer.
10.8 The Buyer will be liable for the cost of return delivery to Addicted to Handbags.
10.9 Upon receipt of the returned Item and successful inspection, Addicted to Handbags will refund the Buyer by the same method as per original payment. Addicted to Handbags does not charge a fee for returns however payments made via Debit/credit card, Paypal or Klarna are subject to a third party processing fee of 3-4% (deducted at source) which is not refundable. The refunded amount for a return will be reduced by the third party payment processing fee and the original delivery cost.
10.10 If the Item is returned in a differing condition to that sent, Addicted to Handbags reserves the right to withhold all or part of the refund. Please note that where any plastic coverings or wrappings have been removed, Addicted to Handbags reserves the rights to refuse a return or make an appropriate deduction. A deduction may also be made for loss in value of any Item supplied, if the loss is the result of unnecessary handling by you or if is damaged in return transit due to inadequate packaging or shipping mishandling. An exchange or credit may be issued at the discretion of Addicted to Handbags.
10.11 Refunds will usually be processed by Addicted to Handbags within 72 hours. Addicted to Handbags has no control over refund timings from third parties.
10.12 For Consignment Sale Items, items are sold As-is and returns are not accepted. Addicted to Handbags acts as a sales platform and legal title to the item does not transfer to Addicted to Handbags at any point. As such all sales are on behalf of a private seller.
10.13 Note for hygiene reasons we cannot take returns on earrings or other jewellery suitable for piercings.
10.14 We retain the right to refuse orders from those customers who have returned two items within a three month period or three items within a six month period.
11. Consignment Service
11.1 Consignment Sales are offered at the discretion of Addicted to Handbags. No assurance is given that an Item accepted will sell at the price proposed, at a reduced price, or at all.
11.2 Initial Resale Prices proposed are on the basis of full disclosure of the Item’s condition, (including aroma) and accompaniments.
11.3 The Item should be sent to Addicted to Handbags within 4 Days of Written Acceptance, securely protected, boxed and via an insured, trackable postal method.
11.4. If the item is not received within 7 Days of Written Acceptance, Addicted to Handbags reserves the right to cancel the Consignment Sale for the Item.
11.5 By sending an Item to Addicted to Handbags the Sender is confirming that:
- they are over 16 years of age;
- the rightful owner of the Item and/or if the Item is being sold on another’s behalf the Sender has the owner’s permission to sell as if their own;
- the Item is not stolen or under hire / subject to any financial agreement;
- the Item may be lawfully sold to consumers without restriction; and
- the Item is as-described and from a non-smoking environment.
11.6 If the Item’s condition on receipt, varies from expected, then Addicted to Handbags reserves the right to amend the proposed Resale Price appropriately. If the proposed Resale Price is not acceptable to the Sender then the Item will be returned to the Sender by fully insured, trackable shipping. The cost of return shipping must be borne by the Sender prior to return. Addicted to Handbags will not be liable for any return Delivery Charge, nor other costs incurred. Any costs of external authentication must also be borne by the sender prior to return. In the event a seller changes their mind requests an item be returned before advertised by Addicted to Handbags, these charges will also apply.
11.7 In the unlikely event that an Item received is deemed to be non-authentic, it will be disposed of and not returned to the Sender. It is a criminal offence to place counterfeit items into the postal service.
11.8 The date of Written Acceptance of the proposed Resale Price constitutes a Sole Marketing Agreement for a period of 20 weeks from that date.
11.9 If the proposed Resale Price is confirmed as not acceptable by the Sender, the Item will be returned to the Sender with the Sender liable for Delivery Charges.
11.10 If a response is not received from the Sender within 3 Days of proposition of the Resale Price then Addicted to Handbags assumes the Resale Price is accepted by the Sender and will proceed to market the Item on the Website at the Resale Price.
11.11 Addicted to Handbags will endeavour to ensure Items are advertised for sale on the Website within 5 Days of receipt of item, however, during busy periods this cannot be guaranteed.
11.12 The Sender may request the return of the Item at any time during the Sole Marketing Agreement Period at which point the % Commission Charge based on the items current Resale Price plus Delivery Charge will be due, prior to the return of the Item.
11.13 Items may be returned to the Sender at any time at the instigation of Addicted to Handbags. If the return is instigated by Addicted to Handbags prior to the end of Sole Marketing Agreement Period, Delivery Charges will be borne by Addicted to Handbags. After the expiry of the Sole Marketing Agreement Period, the Item may be returned to the Sender with the Sender being liable for Delivery Charges prior to the return of the Item.
11.14 Once marketed, control over the Resale Price remains with Addicted to Handbags. Senders may request amendments but alterations to Resale Price are at the discretion of Addicted to Handbags.
11.15 If the Item has not sold within 10 weeks from the commencement of the Sole Marketing Agreement Period, then Sender or Addicted to Handbags may suggest a price reduction or alternative marketing approach. The Sender has the right to refuse a price reduction within the Sole Marketing Agreement Period. If the Item has not sold within the Sole Marketing Agreement Period, and a price reduction is not agreed, the Item may be returned to the Sender with the Sender being liable for Delivery Charges prior to the return of the Item.
11.18 After the expiry of the Sole Marketing Agreement Period, if the Item remains unsold, any outstanding amounts owed by the Sender to Addicted to Handbags must be settled prior to Items being returned, inclusive of Delivery Charges.
11.19 When a sale is achieved and Receipt of Item has occurred, the funds will be transferred to the Sender within 5 Working Days of the item being successfully delivered to their nominated bank account. Addicted to Handbags will not cover or be liable for any bank charges incurred by the Sender for a non UK GBP Bank Account.
11.20 The Sender will receive the Resale Price less the % Commission Charge, less Delivery Charges, less any payment fees deducted at source as agreed with Addicted to Handbags at the outset.
11.21 Addicted to Handbags % Commission Charge is discretionary based on Items Resale Price, desirability and condition. The standard % Commission Charge varies from 10%-25% of the Item’s Resale Price depending on an item’s resale value.
11.22 Whilst the Item remains the property of the Sender until confirmation of delivery to the Buyer has occurred, any photographic images or text created by Addicted to Handbags in relation to the Item, remains the sole property of Addicted to Handbags and cannot be assigned, reproduced or recreated for any commercial purpose.
12. Part-Exchange Service
12.1 A Part Exchange Service is offered at the discretion of Addicted to Handbags and may not be available during some periods throughout the year.
12.2 Initial Part Exchange Prices proposed are on the basis of full disclosure of the Item’s condition, (including aroma) and accompaniments.
12.3 The Item should be sent to Addicted to Handbags within 4 Days of Written Acceptance, securely boxed and via an insured, trackable postal method.
12.4 By sending an Item to Addicted to Handbags the Sender is confirming that:
- they are over 16 years of age;
- the rightful owner of the Item and/or if the Item is being sold on another’s behalf the Sender has the owner’s permission to sell as if their own;
- the Item is not stolen or under hire / subject to any financial agreement;
- the Item may be lawfully sold to consumers without restriction; and
- the Item is as-described and from a non-smoking environment.
12.5 If the Item’s condition on receipt, varies from expected, then Addicted to Handbags reserves the right to amend the Initial Part Exchange Price proposed. If the proposed Initial Part Exchange Price is not acceptable to the Sender then the Item will be returned to the Sender by fully insured, trackable shipping. Delivery Charges must be borne by the Sender prior to return. Addicted to Handbags will not be liable for any return postage costs nor other costs incurred.
12.6 If a response is not received from the Sender within 3 Days of notification of the Initial Part Exchange Price, then Addicted to Handbags assumes the Part Exchange Price is accepted by the Sender and will proceed to market the Item on the Website as per a Consignment Sale in accordance with Section 11 with a commission of 25%.
12.7 The balance of payment due (by either party) to finalise the Part-Exchange Service will be due within 24 hours of Written Acceptance. The Item will remain available for sale on the Website until funds have been received by Addicted to Handbags. If a Buyer or Sender wishes to secure an item in advance, it may be possible to pay a small holding deposit and this can be discussed with Addicted to Handbags on a case by case basis.
12.8 Part Exchange Services within Mainland UK benefit from free Delivery Charges.
12.9 If the Item subject to a Part Exchange Service is to be returned, this is to be undertaken as per Section 10. A refund will be not provided until the Sender’s Item has been sold.
12.10 Items sent as a Part Exchange Service against another Item which is subsequently returned are non-returnable to the original Sender. Any balance due to the Sender will be reduced to the Direct Buy price, per Section 13. Addicted to Handbags reserves the right to return Part Exchange Service Items at their discretion and Delivery Charges will then be borne by Addicted to Handbags.
13. Direct Buy Service
13.1 A Direct Buy Service is offered at the discretion of Addicted to Handbags and may not be available during some periods throughout the year.
13.2 Direct Buy Prices proposed are on the basis of full disclosure of the Item’s condition, (including aroma) and accompaniments.
13.3 The Item should be sent to Addicted to Handbags within 4 Days of Written Acceptance, securely boxed and via an insured, trackable postal method.
13.4 By sending an Item to Addicted to Handbags the Sender is confirming that:
- they are over 16 years of age;
- the rightful owner of the Item and/or if the Item is being sold on another’s behalf the Sender has the owner’s permission to sell as if their own;
- the Item is not stolen or under hire / subject to any financial agreement;
- the Item may be lawfully sold to consumers without restriction;
- the Item is as-described and from a non-smoking environment; and
- they agree to sell the item at the proposed quoted price.
13.5 If the Items condition on receipt, varies from expected, then Addicted to Handbags reserves the right to amend the proposed Direct Buy Price appropriately. If the proposed Direct Buy Price is not acceptable to the Sender then the Item will be returned to the Sender by fully insured, trackable shipping. Delivery Charges must be borne by the Sender prior to return. Addicted to Handbags will not be liable for any return postage costs nor other costs incurred.
13.6 Where the direct buy quote (or range) has been provided by Addicted to Handbags and the seller has agreed and sent the item to Addicted to Handbags, there will be an admin charge of £40 chargeable per item where the seller changes their mind and does not agree to the quoted price or range on receipt of item by Addicted to Handbags. This is subject to agreement by Addicted to Handbags. This charge will also apply where a seller has significantly misdescribed the condition of an item and does not agree to a proposed price once the item has been reviewed in person. Note this does not apply where Addicted to Handbags cannot honour the original quote or range through no fault of the seller. Where an item is deemed to be counterfeit by Addicted to Handbags, this item will be returned to the seller incurring an admin charge of £30 plus return postage costs. If this fee is not paid within 14 days of Addicted to Handbags providing payment details the item will be destroyed. Items will be returned to seller within 10 working days.
13.7. Where the seller sends an item or items to Addicted to Handbags without prior agreement or before receiving a quote, there will be an admin charge of £40 chargeable per item where the seller decides not to accept the quoted price by Addicted to Handbags. This charge covers some of the costs associated with processing, authenticating and returning such items.
13.8 If a response is not received from the Sender within 3 Days of notification of the Direct Buy Price, then Addicted to Handbags assumes the Direct Buy Price is accepted by the Sender and will proceed to remit to the Sender the Direct Buy Price per the agreed payment method.
13.9 All payments are sent to Senders within 24 hours (not including weekends) from the time of agreement of the Direct Buy Price and are provided by Bank Transfer.
13.10. Addicted to Handbags has the right to withdraw any offer of buy outright price before the an item is shipped to Addicted to Handbags. Direct buy quotes are not legally binding offers.
14. Force Majeure
In the event that the Addicted to Handbags is prevented from delivering its services as a result of any cause beyond its control such as, but not limited to, Acts of God, War, Strikes, Lockdowns, Illness or Injury, Epidemics, Addicted to Handbags shall be relieved of its obligations and liabilities to Senders and Buyers for as long as such fulfilment is prevented.
15. Addicted to Handbags retains the right to suspend all or part of its services for any reason, at any time and for any duration.
16. Copyright Statement
You may download, display, print, post and reproduce material from Addicted to Handbags in unaltered form only (retaining this notice) for your personal and non-commercial use, (for example information sharing, opinion gathering and authentication requests). Reproduction of material for commercial use is not permitted, inclusive of these Terms and Conditions.
17. Disclaimer
Addicted to Handbags is not affiliated or a licensed partner of the brands sold, however authenticity is 100% guaranteed. All items are second hand even if described as "as new" condition (that is they all come from previous owners). All items are genuine and authentic, without exception.
Addicted to Handbags is not an authorised dealer of, nor in any way affiliated with, associated with, or endorsed by any of the Designers, Brands or Manufacturers whose products appear on the website. All product trademarks, brand names, and logos are provided for identification purposes only and remain the property of the respective trademark holder without exception. Addicted to Handbags does not claim any rights therein and is not affiliated with the owners of any non-Addicted to Handbags trademarks.
